TERMS OF SERVICE AND CONDITIONS OF USE

PLEASE READ THESE TERMS OF SERVICE AND CONDITIONS OF USE ("TERMS") CAREFULLY BEFORE ACCESSING OR USING THIS WEBSITE ("SITE") OR ANY SERVICES PROVIDED THEREBY. BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SITE OR ANY SERVICES.
1. INTRODUCTION
FedNet, powered by the Office of National Excellence ("ONE") and its affiliated brands, including ON and the telephone number 833-4-FEDNET, is a private, membership-driven, nationwide aggregator for service providers. FedNet’s Platform connects individuals, businesses, nonprofits, and households with a wide range of services—spanning business, nonprofit, personal, home, auto, and other current or future services—by facilitating connections between Members and independent third-party service providers. FedNet does not provide services directly but acts solely as a facilitator to connect you with external providers. Nothing in these Terms shall be construed as creating any agency, partnership, joint venture, or employment relationship between FedNet and any Member or third-party provider.
2. DEFINITIONS
"Member" or "You": Any individual, household, business, nonprofit organization, or entity that registers for a FedNet account.
"Services": The connection facilitation, networking, and access to aggregated service providers offered by FedNet via the Site, mobile app, or other digital interfaces.
"Platform": The website, mobile application, and related digital interfaces provided by FedNet.
"Third-Party Service Providers": Independent entities that offer services (e.g., business services, nonprofit solutions, personal and home services, auto services, etc.) that are accessible through the FedNet Platform.
"Membership Tiers": The various levels of membership available, each providing different levels of access to premium services and exclusive benefits.
"Brand of Excellence": The enhanced status achieved by a Member upon successful registration and approval, which positions the Member as a premium brand in their personal, professional, or nonprofit endeavors.
"Content": All text, images, video, audio, and other materials provided on or through the Site.
"Future Services": Any current or forthcoming services, including but not limited to business, nonprofit, personal, home, auto, and other specialty services that may be integrated into or offered through the Platform.
3. MEMBERSHIP & ACCOUNT CREATION
3.1 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to register for a FedNet account. By registering, you represent and warrant that you meet this requirement.
3.2 Account Creation
To access premium features, you must create a FedNet account by providing accurate and complete information, including your personal, household, business, or nonprofit details. You agree to update such information as necessary and to maintain the confidentiality of your account credentials. FedNet reserves the right to verify, delay, or refuse membership at its sole discretion.
3.3 Membership Tiers and Limited Availability
FedNet offers limited, exclusive membership tiers designed to create a “Brand of Excellence.” These tiers, which include Basic Access, Silver Elite, Gold Elite, Platinum Apex, and Ultra Elite, grant varying levels of access to premium services. Membership in these tiers is limited and subject to approval, and Members may be required to pay a fee corresponding to their chosen tier.
3.4 Conditional Services
The Platform supports two primary usage modes: Members seeking to request services and Members offering their skills. Your registration and responses will determine which services and solutions are recommended to you, including but not limited to instant delivery, staffing and gig work, home services, and business solutions.
4. DESCRIPTION OF SERVICES
FedNet aggregates a comprehensive array of services, both current and future, including but not limited to:
4.1 Business Services:
Professional Solutions: Assistance with website creation, brand development, business marketing, advertisement consulting, and product placement.
Operational Support: Business supply delivery, flyer distribution, menu printing, and strategic consulting.
Employment & Staffing: Access to ON Workforce for gig, temporary, or full-time staffing solutions and talent acquisition.
4.2 Nonprofit Services:
Volunteer Mobilization: Tools for recruiting and managing volunteers.
Fundraising & Marketing: Enhanced outreach, donor networking, and marketing support to amplify your mission.
Community Engagement: Connections with corporate partners and community groups to drive impact.
4.3 Personal Services:
Instant Delivery: Rapid delivery of food, groceries, auto parts, and essential goods via ON Delivery.
Self-Care & Lifestyle: Scheduling for personal services including home cleaning, childcare, tutoring, and wellness services.
4.4 Home Services:
Maintenance & Repairs: Access to reliable home repair, cleaning, lawn care, and appliance services.
Household Management: Services such as laundry, auto-replenishment, and home organization to streamline daily living.
4.5 Auto Services:
Repair & Maintenance: Connections to mechanics, auto repair shops, and auto parts suppliers.
Roadside Assistance: Immediate support for vehicle breakdowns, flat tires, and fuel emergencies.
4.6 Gig & Delivery Services:
FedNet Fleet: Join as a delivery driver to earn cash instantly for on-demand deliveries.
ON Workforce: Job board for gig work, temporary staffing, and service jobs.
4.7 Additional and Future Services:
Retail & Personal Care: Access to beauty supply stores, hair salons, barbershops, and nail salons.
Hospitality & Security: Hotel bookings, security services, and legal consulting.
Specialized Services: Including but not limited to psychotherapy, pet services, cultural programs, and creative marketplaces.
FedNet’s Platform continuously evolves, and we may integrate additional services in the future based on emerging market needs and technological advancements.
5. LIMITATION OF LIABILITY & ASSUMPTION OF RISK
5.1 General Disclaimer
THE SITE, PLATFORM, AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FEDNET DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
5.2 Limitation of Liability
IN NO EVENT SHALL FEDNET, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, ANY TRANSACTIONS, OR YOUR INTERACTION WITH THIRD-PARTY SERVICE PROVIDERS. THE AGGREGATE LIABILITY OF FEDNET SHALL NOT EXCEED THE AMOUNT PAID, IF ANY, BY YOU FOR ACCESSING THE SITE.
5.3 Assumption of Risk
BY USING THE SITE AND SERVICES, YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR INTERACTIONS, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS, OMISSIONS, OR DELAYS IN SERVICE. YOU ACKNOWLEDGE THAT FEDNET IS NOT RESPONSIBLE FOR THE QUALITY, PERFORMANCE, OR RELIABILITY OF ANY THIRD-PARTY SERVICE PROVIDERS.
6. INDEMNIFICATION
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS FEDNET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES FROM ANY CLAIMS, LOSSES, DAMAGES, LIABILITIES, COSTS, OR EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, VIOLATION OF THESE TERMS, OR INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHTS.
7. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State where FedNet is incorporated, without regard to its conflict of law provisions. Any disputes arising out of these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in that State.
8. CHANGES TO TERMS
FedNet reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.
9. MISCELLANEOUS
9.1 Entire Agreement:
These Terms constitute the entire agreement between you and FedNet regarding your use of the Site and supersede all prior agreements.
9.2 Severability:
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force and effect.
9.3 No Waiver:
The failure of FedNet to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
9.4 Independent Contractors:
The relationship between you and FedNet is solely that of an independent contractor. Nothing in these Terms creates a partnership, joint venture, or employment relationship.
9.5 Not a Government Entity:
FedNet, ONE, ON, and 833-4-FEDNET are privately owned and operated. They are not government agencies, nor are they authorized government contractors. References to “federal” or similar terms denote our nationwide scope, not any governmental authority.
9.6 Brand of Excellence:
By creating a FedNet Account, you acknowledge that you are engaging in a process designed to transform you into a "Brand of Excellence." You agree that you assume full responsibility for all outcomes resulting from your membership and the use of the Site, and that FedNet’s role is solely to facilitate connections with independent service providers.
9.7 Future Services:
FedNet may, at its discretion, add, remove, or modify the services available through the Platform. This includes but is not limited to business services, nonprofit services, personal services, home services, auto services, and any additional offerings developed in the future.
